Pre-marketing conditions for EU AIFMs within the Republic of Croatia

Authorized EU AIFMs may engage in pre-marketing activities in the Republic of Croatia, in accordance with Article 30a of the Directive 2011/61/EU which is transposed in Article 119.a of the Alternative investment funds Act.

In line with the provision of citied Articles, an EU AIFM shall send, within two weeks of it having begun pre-marketing, an informal letter, in paper form or by electronic means, to the competent authorities of its home Member State.

That letter shall specify the Croatia as a Member States in which and the periods during which the pre-marketing is taking or has taken place, a brief description of the pre-marketing including information on the investment strategies presented and, where relevant, a list of the AIFs and compartments of AIFs which are or were the subject of pre-marketing.

The competent authority of the home Member State of the EU AIFM shall promptly inform Hanfa as regarding the AIFM’s engagement in pre-marketing.

Hanfa may request the competent authority of the home Member State of the EU AIFM to provide further information on the pre-marketing that is taking or has taken place on its territory.
