27th Meeting

On 10 December 2024, the Board of the Croatian Financial Services Supervisory Agency held its 27th meeting and adopted the following decisions of public interest:

1. Ordinance on the calculation basis and manner of charging the asset management fee 
2. Ordinance on organisational requirements of pension insurance companies 
3. Ordinance on the minimum content of the recovery plan of pension insurance companies 
4. Ordinance on regular reports and content of the notification relating to proposed unit amounts of pensions and payments guaranteed to defined beneficiaries of pension insurance companies 
5. Decision on the maximum percentage of the fee paid to the depositary for the year 2025
6. Decision on compliance with the Joint Guidelines on the oversight cooperation and information exchange between the ESAs and the competent authorities under Regulation (EU) 2022/2554 (JC/GL/2024/36) 
7. Decision granting approval to Središnje klirinško depozitarno društvo d.d., (Central Depositary and Clearing Company), with its registered office in Zagreb, OIB: 64406809162, LEI: 747800V0CCQGC89GOW91, for the management fee relating to the management of the Investor Protection Scheme for the year 2025, totalling EUR 1,673.00 per year, per each member of the Investor Protection Scheme 
8. Decision granting approval to the company SQ CAPITAL društvo s ograničenom odgovornošću za upravljanje investicijskim fondovima, with its registered office in Zagreb, OIB: 54009254385, LEI: 74780060FBJISKZVMH34, for the merger of Anchor, open-ended alternative investment fund with private offering, ISIN: HRZDINUANCR6, LEI: 747800T09D4NZH5LL035, with Primus, open-ended alternative investment fund with private offering, ISIN: HRLOINUPRIM0, LEI: 74780000606HS2Y8AI20 
9. Decision determining that the company TIKOMAR d.o.o., with its registered office in Zagreb, OIB: 25863653771 did not provide for organisational conditions and did not put in place the internal control system necessary for an effective and efficient AML/CFT system.  The Company is ordered to notify all of its clients of the termination of operations, to refund funds or virtual assets held on behalf of clients to clients without delay, close all crypto-ATMs and request deletion from the court register of the Commercial Court in Zagreb of the activity of exchange services between virtual currencies and fiat currencies and activity of providing custodian wallet services and to notify Hanfa of the implementation of the above. 
10. Decision rejecting the application for the entry into the Register of virtual asset service providers filed by the company Prometheus Trading j.d.o.o., with its registered office in Zagreb, OIB: 31657229043 
11. Decision determining that during the on-site examination (CLASS: UP/I 994-08/22-01/05) of part of the operations of the company Groupama osiguranje d.d., Zagreb, OIB: 98164456048, LEI: 74780000V0JHQ18WXI81, the Company fully accepted the recommendations set out in the Report on the on-site examination of 11 November 2024, and termination the on-site examination (CLASS: UP/I 994-08/24-01/09)
12. Decision granting authorisation to Marko Klemenčič from Otočac to perform the function of a member of the Management Board of the company MERKUR OSIGURANJE d.d., Zagreb, OIB: 08937835435, LEI: 529900S781HTTWM6KC58, for a term lasting from 1 January 2025 to 31 December 2028 
13. Decision granting authorisation to Anita Markota Štriga from Zagreb to perform the function of a member of the Supervisory Board of the company Wiener osiguranje Vienna Insurance Group d.d., Zagreb, OIB: 52848403362, LEI: 54930041AKTSEYG3RV93, for a term lasting four (4) years 
14. Decision granting authorisation to Tomislav Novačić from Zagreb to perform the function of a member of the Management Board of the company AGRAM LIFE osiguranje d.d., Zagreb, OIB: 18742666873, LEI: 74780000R0XHH10VC697, for a term lasting 5 (five) years 
15. Decision granting authorisation to conduct insurance distribution business to Alen Pajković from Rovinj, founder of the insurance representation craft IN FOCUS LION, obrt za zastupanje u osiguranju, vl. Alen Pajković, Rovinj, Naselje Gripole 45 
16. Decision granting authorisation to conduct insurance distribution business to Marta Belaj from Varaždin, founder of the insurance representation craft NAJPOLICA, obrt za zastupanje u osiguranju, vlasnik Marta Belaj, Varaždin, Vatrogasna ulica 1 
17. Decision granting authorisation to conduct insurance distribution business to Tomislav Vučur from Zagreb, founder of the insurance representation craft KONTRA - obrt za zastupanje u osiguranju, Tomislav Vučur, Zagreb, Jačkovina 38 
18. Decision determining that the authorisation to conduct insurance distribution business issued on 22 December 2011 to Vanja Dojkić from Zagreb, founder of the insurance representation craft DOJKIĆ ZASTUPANJE U OSIGURANJU, VL. VANJA DOJKIĆ, ZAGREB, ALEJA SELJAČKE BUNE 5, by virtue of Hanfa’s Decision CLASS: UP/I-453-02/11-37/103, REGNO: 326-112-11-2, ceased to be valid on 11 November 2024
