22nd Meeting

On 16 October 2024, the Board of the Croatian Financial Services Supervisory Agency held its 22nd meeting and adopted the following decisions of public interest:

1. Ordinance amending the Ordinance on the requirements for membership in management and supervisory boards of pension insurance companies
2. Ordinance on the contents of the application for taking over a pension insurance company’s pension contracts portfolio
3. Ordinance on pension insurance companies’ pension scheme distribution
4. Ordinance amending the Ordinance on the requirements for performing a key function in a pension insurance company
5. Ordinance on marketing activities and website of pension insurance companies
6. Ordinance on the partial lump sum payment made to the old-age and early old-age basic pension beneficiaries
7. Decision granting approval to the company Središnje klirinško depozitarno društvo d.d., Zagreb, OIB: 64406809162, LEI: 747800V0CCQGC89GOW9 (Central Depositary and Clearing Company), to amend its operating rules. The company is obliged to publish the adopted amendments to the Rules and Instruction of the Central Depositary and Clearing Company on its website and inform its members of their adoption in a timely manner. 
8. Decision ordering the company Moneysail d.o.o., Zagreb, OIB: 53104623333, to ensure that its Management Board runs its business operations from the territory of the Republic of Croatia and to ensure organisational requirements needed for an effective and efficient anti-money laundering and terrorist financing system without delay; and ordering the company to inform Hanfa of the fulfilment of this decision without delay
9. Decision suspending the execution of Hanfa’s Executive Decision of 23 September 2022 relating to the company EUROHERC osiguranje d.d., Zagreb, OIB 22694857747, laid down in Hanfa’s Decision on execution of 5 December 2023
10. Decision determining that the credit institution Raiffeisenbank Austria d.d., Zagreb, OIB: 53056966535, LEI: 529900I1UZV70CZRAU55, has acted in line with a special supervisory measure referred to in point I of the operative part of Hanfa’s decision of 4 June 2024; and that pursuant to that point of the operative part of the decision the internal audit function has carried out a test and assessment of the suitability and efficiency of the process controlling investment limitations (laid down in laws, by-laws and prospectuses) of funds whose depositary is the credit institutions in question, and of the suitability and efficiency of the internal control system within that process; and that the credit institution has submitted an internal audit function report on the assessment with the accompanying documentation and evidence testifying to the implementation of the special supervisory measure; as well as the measures and procedures the credit institution has carried out to improve the performance of depositary control tasks; and determining that the illegalities and irregularities established in the Off-Site Inspection Report of 28 March 2024 have been eliminated and that the off-site inspection procedure has been terminated
